Agreement to terms

By using the Site and its offerings, including courses, programmes, services or products, you agree to these Terms & Conditions and our Privacy Policy. You must be at least 18 years old to agree to these terms. If you are under 18, or do not agree with these Terms & Conditions, please discontinue using the Site immediately.

Definitions

• "Company", "We", "Us" refers to DC Life OÜ, trading as DC Health.
• "Content" includes all written, visual, video or audio information on the Site, including emails, blog posts, graphics, documents, templates and materials.
• "Personal Information" means any information that can identify you, such as name, address and email.
• "Site, Courses, Services and/or Products" encompasses all offerings available on dinacelina.com.

Consent and compliance

By using the Site, you consent to these Terms & Conditions and confirm that you comply with the local laws applicable to you. You agree not to misuse the Site or its Content. This includes, but is not limited to, refraining from posting offensive content, violating intellectual property rights, engaging in illegal activities, or using the Site for unauthorised marketing.

Health disclaimer & your responsibilities

Our Services, Courses and Content are provided for informational and educational purposes only. We do not provide medical, legal or other professional advice, and nothing we provide is a substitute for the care of your GP or a qualified medical professional. We are not your doctor, and our Services do not constitute medical diagnosis or treatment.

You are responsible for disclosing relevant and accurate health information (including medical conditions, medications, allergies, and whether you are pregnant or breastfeeding); for consulting your doctor before making changes to your diet, supplements, exercise or lifestyle; and for seeking medical attention where appropriate. You take part voluntarily and accept responsibility for your own health decisions and outcomes.

No guarantee of results

Nutrition, gut health and lifestyle outcomes vary from person to person and depend on many factors, including your individual circumstances and how closely you follow any guidance provided. We make no guarantee, representation or warranty that you will achieve any particular result. Any testimonials, case studies or examples shared reflect individual experiences and are not a promise or guarantee of similar outcomes for you.

Intellectual property

The Site and its Content are the exclusive property of DC Life OÜ and are protected by applicable intellectual property laws. You may not copy, reproduce, republish, distribute, resell, share or otherwise exploit any Content, in whole or in part, without our prior written permission. Any unauthorised use may lead to legal action.

Use of anonymised information & marketing

By engaging our Site, Courses, Services and/or Products, you grant DC Health a non-exclusive, royalty-free permission to use information arising from your participation, including, but not limited to, results, progress, blood markers, feedback, comments and any photographs or written or verbal testimonials you provide, for marketing, promotional, educational and case-study purposes across our website, social media, email and other channels.

Where such information is used for these purposes, it will be anonymised and stripped of identifying personal details (such as your name, face and contact information), unless you have given separate, explicit written consent to be identified. You may withdraw this permission at any time by emailing contact@dinacelina.com, after which we will stop using your information for future marketing, although we may be unable to recall or remove material that has already been published or distributed.

Confidentiality

We treat the personal and health information you share with us as confidential and handle it in line with our Privacy Policy. In return, any confidential information, materials or methods we share with you remain confidential and must not be disclosed or shared with third parties without our written permission.

Purchases and access

Your purchase or use of our Services and Products is subject to these Terms & Conditions. Unauthorised distribution or sharing of purchased materials is strictly prohibited.

Payment & purchases

When you purchase or download one of our Courses, Services or Products from us or the Site, you may pay by PayPal or Stripe. By doing so, you permit DC Life OÜ to automatically charge your payment method. You will receive an electronic receipt following your purchase, which you should retain for your records. If you elect the instalment or "pay over time" option at checkout, you agree that DC Health has permission to automatically charge, without checking with you before each instalment transaction, the amount due on the date(s) agreed upon at checkout.

If your payment method fails or is otherwise declined, you may be removed from or cancelled from access to our Courses, Services and Products. Please note that, in the event your payment method is declined at any time, you remain responsible for the full cost of your purchase. We do not accept any chargeback threats (real or threatened). If any chargebacks are placed on a purchase or download of our Courses, Services or Products, we may report the incident to the relevant credit reporting agencies, which could negatively affect your credit report and/or credit score. If you would like such a report removed, please contact us to arrange for payment owed; once received, we will make the appropriate reports.

Payment processing companies may have different privacy policies and practices than we do, and we are not responsible for their policies. As with any online purchase, there are circumstances beyond our control which may compromise your card or payment method, and we are not liable for those circumstances. You hereby release us from any and all damages related to your payment or use of our payment processing companies, and agree not to assert any claims against us or them for damages arising from your purchase or use of our Site and its Content.

Refund policy

Our refund policy is detailed on the Site. Generally, refunds are not provided for services rendered or products purchased. Digital products, downloads and completed sessions are non-refundable except where required by law.

Cancellation & rescheduling

If you need to cancel or reschedule a consultation or appointment, please give us as much notice as possible, and at least 48 hours where you can. Sessions cancelled with less than the required notice, or missed without notice, may be charged in full or forfeited. Programme and course purchases are subject to the Refund Policy above.

Limitation of liability

DC Life OÜ is not responsible or liable in any way for any and all damages you receive, directly or indirectly, from your use, purchase or download from our Site, Courses, Services and/or Products. We do not assume liability for damages, injuries, harm, death, or misuse of (or failure to properly use) information or documents, due to any act, or failure to act, by you. In no event shall we be liable to you for any indirect, special, exemplary or consequential damages. Nothing in these terms excludes liability that cannot be excluded under applicable law.

Third-party links

The Site may contain links to third-party websites. We are not responsible for their content or privacy practices.

Termination of your use

At our sole discretion, we are permitted to terminate your use of or access to the Site, Courses, Services and/or Products, and purchases or downloads, if you abuse, violate or breach any of these Terms & Conditions, our Privacy Policy, Disclaimer, or any other terms to which you have agreed.

Arbitration agreement

Where permitted by law, any disputes will be resolved through binding arbitration, waiving the right to a jury trial or court proceedings.

Jurisdiction and governing law

These Terms & Conditions are governed by the laws of Estonia. Any disputes will be resolved within the jurisdiction of the EU / Estonia.

Severability & entire agreement

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms & Conditions, together with our Privacy Policy and Disclaimer, make up the entire agreement between you and us regarding your use of the Site, Courses, Services and Products.

Amendments to these terms

We reserve the right to modify these Terms & Conditions at any time. The updated version will be posted on the Site.
